This privacy policy of SeizetheDeal.com (this "Privacy Policy") describes how Townsquare Commerce, LLC, a Delaware limited liability company (the "Company", "us" or "we"), collects, uses, discloses and otherwise processes information about you when you access or use the SeizetheDeal.com Internet website, related mobile applications, online features, emails, advertisements and other services that link to this Privacy Policy (collectively, the "Website").

This Privacy Policy also explains privacy choices that may be available to you, including rights available to residents of certain U.S. states. By accessing or using the Website, you acknowledge that you have read and understand this Privacy Policy.

Section I

Collection of Information

We collect information that you provide to us, information that is collected automatically when you use the Website, and information we receive from other sources, including service providers, advertising partners, affiliate providers, data brokers and other commercial partners.

When you visit or use the Website, we, our service providers, advertisers, advertising networks, analytics providers, social media platforms, data brokers and other ad-tech partners may automatically collect information from your browser, device, and interactions with the Website. This information may include IP address, device identifiers, advertising identifiers, cookie identifiers, browser type, operating system, referring and exit pages, pages viewed, search terms, links clicked, content interactions, approximate location, timestamps, transaction-related activity, and other information about your use of the Website. We may collect this information through cookies, pixels, web beacons, tags, embedded scripts, software development kits, local storage and similar technologies. Some of this information may be considered personal information under applicable law.

2. Information You Provide. We may collect information that identifies, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household. This may include name, mailing address, billing address, email address, telephone number, date of birth, account credentials, purchase history, voucher and ticket information, communications with us, survey responses, contest or sweepstakes entries, feedback, user-generated content, marketing preferences, job application information, and other information you choose to provide when you create an account, order a product or service, submit or post content, enter a contest or sweepstakes, sign up for an offer, complete a survey, request support, submit information, or otherwise interact with us (collectively, "Identification Activities" or individually an "Identification Activity"). When you order products or services, we or our payment processing partners may collect payment and transaction information. For direct payment card transactions, we may receive your name, billing address, card number, expiration date, CVV number and related authentication information through a secure web form and transmit that information by secure protocol to our payment processing partner. We store only the last four digits of your credit card and do not store your other credit card information locally. Some information is required to provide the Website or complete a transaction. If you do not provide required information, you may not be able to engage in the applicable activity or use certain Website features.

We may use information that does not identify and cannot reasonably be linked to you, including aggregated or de-identified information, for any lawful business purpose. We do not attempt to re-identify de-identified information except as permitted by applicable law.

Use and Disclosure of Personal Information

We may use personal information to operate, maintain and improve the Website; create and manage accounts; process purchases, payments, vouchers, tickets, refunds and customer service requests; deliver products and services; communicate with you; send administrative and promotional communications; personalize content, offers and advertising; measure and improve the Website, advertisements and marketing campaigns; conduct analytics and research; prevent, detect and address fraud, security incidents, misuse and technical issues; enforce our agreements; comply with legal obligations; respond to law enforcement or legal process; and for other purposes disclosed to you or with your consent. We may use correspondence you send to us for training, quality assurance, marketing and promotional purposes, subject to applicable law. We may disclose personal information as provided below:

1. Affiliate Providers and Business Partners. We may provide products, services, vouchers, tickets, offers, contests, promotions, advertising or other features jointly with certain restaurants ("Participating Restaurants"), retail businesses ("Affiliated Businesses," and together with Participating Restaurants, "Affiliate Providers"), sponsors, advertisers and other business partners. We may disclose personal information to these parties to process and fulfill your purchases, provide customer support, deliver or redeem offers, measure program value, administer promotions, and permit them to market products and services directly to you where permitted by law. We will share personal information with Affiliate Providers where you are involved in an Identification Activity or where otherwise disclosed to you.

2. Service Providers. We may engage third party service providers, processors, contractors and vendors (the "Service Providers") to help us operate and administer the Website, process payments, provide products and services, host data, deliver email, provide customer support, perform analytics, detect fraud, maintain security, troubleshoot issues and perform other business functions. These Service Providers may process personal information on our behalf. For example, we may disclose payment information, directly or indirectly, to payment processors, card networks, banks and related parties to process or confirm payment, and we may disclose address or contact information to delivery, fulfillment or customer service providers where applicable.

3. Advertising, Analytics and Data Partners. We, and third parties acting on our behalf, may share your Personally Identifiable Information, and may allow third parties to collect information about your activity on the Website through Cookies, Web beacons and similar technologies, for analytics, measurement, attribution and targeted or interest-based advertising, including advertising directed to you on other websites and applications over time. The categories of recipients include advertising networks, ad-tech providers, analytics providers, social media platforms and data brokers. Depending on the technologies used, these practices may be considered a "sale" or "sharing" of personal information under certain state privacy laws. The advertising, analytics and data partners with which we work include, among others, AppNexus, Amazon, Blis, Blockthrough, Cadent Aperture MX, Concert (Vox Media), Conversant, Criteo, EMX, Flipp, Gamera, Google, GumGum, ID5, Improve Digital, InMobi, Index Exchange, Kargo, LiveIntent, LiveRamp, Media.net, Nativo, Nexxen, Nimbus, Onetag, OpenX, Primis, PubMatic, Pulsepoint, Revcontent, RhythmOne, Rubicon Project (Magnite), Seedtag, Sharethrough, Smaato, Sovrn, StackAdapt, Teads, The Media Grid, The Trade Desk, Tonefuse (formerly Bandsintown), TripleLift, Undertone, Unruly, Verve, Vidazoo, Wunderkind and YieldMo. Certain of these partners are accessed through Google's ad exchange (AdX) or Amazon's Transparent Ad Marketplace (TAM).

4. Payment Processors. In some cases, we use third party payment processors, which may vary depending on the Website feature you use and the product or service you purchase. These processors may collect payment card, bank account, billing and transaction information directly from you. In those cases, we do not receive or store your full credit card or bank account information, and you should not send that information to us outside the payment process. Please review the terms of use and privacy policies of the third party payment processor before providing your information to them.

5. Business Transaction. If the Company is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction, personal information may be disclosed to or transferred as part of that transaction, including to a successor, purchaser, investor, lender, advisor or other transaction participant.

Law; Safety. We may disclose personal information when we believe disclosure is appropriate to comply with applicable law, regulation, legal process, court order, subpoena, or governmental request; enforce or apply this Privacy Policy or other agreements; investigate, prevent, or address fraud, security, misuse, or technical issues; or protect the rights, property, goodwill, safety, or security of the Company, the Website, our users, or others.

The privacy practices of Affiliate Providers, business partners, payment processors, advertisers, advertising networks, analytics providers, data brokers, social media platforms and other third parties may be governed by their own privacy policies and terms. We are not responsible for the privacy practices of third parties that are not acting on our behalf.

Section IV

You may update certain account information by logging into your account, sending us an email at support@seizethedeal.com, using the data request form described in Section IX below, or writing to us at our business address provided in Section IX. Please indicate your name, mailing address, email address and the information you would like to update. You may request that we delete personal information we collected from you, subject to applicable exceptions. For example, we may retain transaction information, payment records, fraud-prevention records, legal compliance records, backup copies and other information where permitted or required by law. See Section IX(4) of this Privacy Policy for more details.

Section V

Administrative and Promotional Communications

Your submission of information to the Company is optional, although we may require certain information if you want to engage in particular Website activities. We may send you administrative, transactional and service-related communications about your account, requests, inquiries, purchases, vouchers, tickets, transactions, security, policy updates and other Website activity. You may not opt out of these communications if they are necessary to provide the Website or complete a transaction. We may also send promotional communications advertising our products and services, exclusive sales, special offers and/or the products and services of our advertisers, affiliates and business partners, subject to applicable law. If you do not want to receive Promotional Emails from us, you may opt out at any time by sending an email to support@seizethedeal.com, by written request mailed to us at our business address provided in Section IX, or by clicking the "unsubscribe" button at the bottom of any Promotional Email. When contacting us, please indicate your name, address, email address and the Promotional Emails you do not want to receive.

Section VI

Security of Information

You can access your account information on our Website through your email address and password. You are responsible for maintaining the safety and security of your password, and we recommend that you do not share your password with anyone. We use commercially reasonable administrative, technical and physical safeguards designed to protect personal information, including encryption of certain sensitive information in transit using Secure Socket Layer (SSL) or similar technology.
No website, system, or transmission over the internet is completely secure. We do not guarantee the security of information transmitted to or from the Website, and you provide information to us at your own risk. We also are not responsible for the acts or omissions of third parties that may receive information as described in this Privacy Policy.

Section VII

Cookies, Tracking Technologies and Interest-Based Advertising

We and third parties may use cookies, pixels, web beacons, tags, embedded scripts, local storage, software development kits and similar technologies to operate the Website, remember preferences, maintain security, measure performance, understand usage, personalize content and ads, perform analytics, attribute transactions, prevent fraud and deliver interest-based, cross-context behavioral and targeted advertising. Section IX

Miscellaneous

1. Changes and Updates. We may change this Privacy Policy at any time by posting the revised Privacy Policy on this page. It is your responsibility to review the Website and the Privacy Policy to learn of any revisions to this Privacy Policy. Your continued use of the Website after a change to the Privacy Policy will constitute your acknowledgment and acceptance of the terms of the revised Privacy Policy.

2. Children. Minors under the age of 13 may not use the Website. We do not collect or maintain information from anyone known to be under the age of 13, and no part of the Website is designed to attract anyone under the age of 13. We do not knowingly sell (as defined by the California Consumer Protect Act), the personal information of minors under 16 years of age to non-affiliated third parties without affirmative authorization.

We cannot respond to your request or provide you with information if we cannot verify your identity or authority to make the request and confirm the information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use information provided in a verifiable consumer request to verify your identity or authority to make the request. You may only make a verifiable consumer request for access or data portability twice within a 12-month period.

     • To verify your identity, we ask that you provide us with the following information when you submit your request: (a) first name; (b) last name; and (c) phone number or email. We will use the above information to verify your identity.
